Website Giveaway Terms & Conditions

These Terms & Conditions (“Terms”) govern the “Done‑For‑You Website Giveaway” (the “Giveaway”) offered by MarketSmartGuide.com (“we,” “us,” or “our”). By entering the Giveaway or accepting a prize, you agree to these Terms.

1. Overview of the Prize

• We are giving away up to 100 done‑for‑you websites over the course of 2026 with 1 year of hosting included as part of our broader 1,111‑prize promotion.
• Each winner (“Winner”) receives:
• One custom WordPress blog or service‑based information website (the “Website”).
• Hosting for 12 months from the date the Website goes live.

No ecommerce, membership, or complex web‑app functionality is included in this Giveaway.

PLEASE NOTE: The number of prizes awarded in each draw is based on the total number of eligible entries received by the end of each entry period. We may adjust the number of prizes awarded per period according to the following publicly posted tier structure, up to a maximum of 100 website prizes during our entire 12 month campaign.

• At fewer than 500 new entries each month: we draw 1 website winner.
• At 500–999 new entries each month: we draw 2 website winners.
• At 1,000+ new entries each month: we draw 3 website winners, etc., with a maximum of 8 website winners for any given month.
• + additional prizes are unlocked proportionally as well.

2. Eligibility

• Open to new and small business owners (solo entrepreneurs, small teams, or early‑stage businesses).
• You must be at least 18 years old (or the age of majority in your jurisdiction).
• We reserve the right to decline or disqualify any entrant or Winner if:
• Their proposed content is illegal, hateful, adult, or otherwise inappropriate, or
• Their business clearly does not align with our values or technical limits.

Prizes are non‑transferable and may not be resold or assigned without our written consent.

3. Domain Requirements

• Each Winner must use a custom domain for their Website.
• Winners must either:
• Register a new domain through Hostinger at the then‑current rate, or
• Transfer an existing domain to Hostinger before we begin work.
• All domain fees, renewals, and DNS management costs are the responsibility of the Winner.

We cannot start building the Website until the domain is registered or transferred and properly connected.

4. Hosting, Access, and Renewal

• Hosting for the Website is included for 12 months from the date the site is first launched.
• After the first year, hosting renews at $120 per year, payable at least 14 days before the renewal date to avoid interruption.
• If hosting payment is not received by the due date:
• The Website may be suspended, and
• It may be permanently removed after a reasonable grace period at our discretion.

Login access

• During the first year, all Websites are fully managed by MarketSmartGuides.com. Winners do not receive direct backend login access.
• After the first year, Winners may unlock direct login access for a one‑time $50 account setup fee (per Website).
• Once direct access is granted, Winners are responsible for any changes they make; additional support outside our standard scope may be billable.

5. Website Scope and Limits

Each prize Website includes:

• Site type:
• A WordPress blog or service‑based information site (no ecommerce, membership, course platforms, or custom web apps).
• Structure:
• Up to 5–7 core pages (e.g., Home, About, Services, Contact, Blog, etc.).
• One contact form or booking link integration.
• Storage & inodes:
• Up to 1 GB storage and 150,000 inodes (files & directories) per site.
• If usage exceeds these limits, additional fees may apply, which will be quoted in advance.

Custom coding, advanced integrations, or additional pages/features beyond this scope are not included in the prize, but may be available as separate paid services.

6. Content & Design Responsibilities

To qualify for their Website build, Winners must:

• Provide all required materials within 10 days of being notified as a Winner, including:
• Final text copy for each page.
• Brand colors (preferably hex codes) and logo files.
• Any images, photos, or graphics they own or have licensed.
• Links to 3 example websites they like for look and feel.

• Ensure all content supplied:
• Is accurate and lawful.
• Does not infringe on any copyrights, trademarks, or other rights.

If a Winner does not provide the required content within 10 days:

• We may put their project on hold until a later slot is available, or
• At our sole discretion, we may treat the prize as forfeited with no replacement.

We are not responsible for writing copy, sourcing images, or creating logos under this Giveaway, unless explicitly agreed as a separate paid service.

7. Build Process, Timeline, and Revisions

Once all required content and domain setup are complete:

• We will deliver a first draft of the Website within approximately 10–14 business days (subject to volume and our schedule).
• The Winner then has 7 days to review the Website and submit one consolidated list of requested changes.

Included revisions:

• 1 round of minor revisions (e.g., text edits, color tweaks, replacing provided images, small layout adjustments).

Not included and billed separately:

• Additional rounds of revisions.
• Major redesigns or structural changes.
• Adding new pages or features outside the agreed scope.

If no feedback is received within 7 days, we may consider the Website accepted and move it to “live” status.

8. Consultation & Ongoing Support

• Each Winner receives up to 2 hours of free consultation, which may cover:
• Strategy questions.
• Site walkthrough.
• Basic launch guidance.
• After the complimentary 2 hours, additional consultation and support is billed at $15 per hour, in 30‑minute increments.

Examples of what may be billable after launch:

• Ongoing content updates.
• Layout changes.
• Feature additions or new integrations.
• Conversion optimization and strategy work.

Bug fixes or issues directly caused by our work within the first 7–14 days after launch are typically covered at no additional cost, at our discretion.

9. Acceptable Use & Content Restrictions

Winners may not use their Website for:

• Illegal activities.
• Adult content or explicit material.
• Hate speech, harassment, or incitement to violence.
• Fraudulent or deceptive practices.

We reserve the right to suspend or terminate a Website and/or rescind the prize if the site is used in a way that violates these rules, applicable law, or our hosting provider’s policies.

10. Data, Backups, and Migration

• We maintain regular backups as part of standard hosting practices; however, we do not guarantee zero data loss.
• Winners are encouraged to maintain their own copies of important content.
• If a Winner later chooses to move their site to another host:
• We can provide reasonable assistance or export, which may be billable, depending on scope.

11. Marketing & Portfolio Use

• By accepting the prize, Winners grant MarketSmartGuides.com the right to:
• Display screenshots or public pages of their Website in our portfolio.
• Reference the project in our marketing or case studies.
• Sensitive information (e.g., private dashboards, internal data) will not be shared.
• Winners may request that we do not publicly showcase their site, and we will make reasonable efforts to honor that request going forward.

12. Limitation of Liability

• The Website and hosting are provided “as is” under the scope described.
• We are not liable for:
• Lost profits, lost opportunities, or business interruptions.
• Issues arising from domain registrars, third‑party services, or content supplied by Winners.
• Our total liability related to the Giveaway and any Website build is limited to the value of the hosting and build services provided as part of the prize.

13. Changes to These Terms

We may update or modify these Terms at any time. The version posted on our Website at the time of entry or at the time of prize notification will apply to that Winner’s project.
